Exactly. In a low-to-mid magic setting, he's going to have a hard time against all the sneak/crit immune critters.
Also, I would advise taking Knockdown and IKD over Expertise and Improved Expertise. Drop Toughness, and take WS instead. An epic-dodging SC halfling has no need of hitpoints.
You also manage only a 16BAB in spite of 10 Fighter levels pre-epic. I would consider taking 9 fighter and 11 Rogue and postponing that SD level until Epic. I would also take that 10th fighter level in Epic to nab your EWS and to top out discipline.
In regard to SD, I would actually take 10 levels of it in this build and take only 19 Rogue. If 19 Rogue can't deliver on what you need, chances are 29 Rogue won't either. But the 10 SD will give you better defenses, and pick up all you SC and Epic Dodge feats faster than what the Rogue side could deliver.
Finally, make sure you take Rogue on Lvls 12 and 17 so you can top up your Tumble skill for instant +1 to AC. You could also do this at level 3, and postpone that 2nd Ftr level to 4. Remember, at lower levels it's not his AB that's the wek point but his AC.
And one last thing: this definitely does not look right--

Weapon specialization is something im trying to fit in atm just cant find where , on regards to the ewf thanks for pointing that out it should read this....
i was trying to get the ewf in earlier but forgot about rogue bonus feats Doh!

I don't think you can take Weapon Finesse at level one as a Rogue.
All my Rogue character sheets show me taking it at level 3.

nice rebuild. you can't take weapon finesse as a rogue at level 1, it requires a 1+ BAB (warriors at lvl 1 only) you cannot take weapon spec at level 3 (ever), and only after 4 lvls of fighter, not 2. with a little switching around, should be doable. interesting build, but some more SD would also help with defense, allowing you to drop expertise and take knockdown. helps get those sneaks in.

I would also advise moving your dual-wielding feats to earlier in the build, and moving your SD pre-reqs back (since you're not taking SD till epic levels).
Also, you should post your class level next to the character level. This helps readers follow the build, it helps you to spot errors in the build, and generally makes it easier to discuss. For example:

yep ive got it worked out now i playtested it it found out all the probs you guys mentioned the hard way and will be posting the next version soon

What abot moving your last fighter level to post epic taking epic weapon specialization. Also a power attack feat might help vs. crit/sneak immune opponents. You porbably could swap out blinding speed and improved expertise for those. Yes its leaning more on the PvM side but it should do fine against most characters in PvP but hey when you cant hurt those guys (palemasters, shifters etc etc) hips and if they have true seeing then theres nothing for it but to RUN!!!! _________________ You do not simply exist, but decide what your existance will be. Now that should work and get through any problems mensioned, apart from moving my last fighter level to epic and taking epic wep spec but that would lose me blind fight so its a matter of personal preference there

I'd follow the dwarflord's advice and go 19 rogue/10 sd. Anyhow you still miss EWS which in a dex build is very helpful against crit immunes
